Terms of Service
Effective August 5, 2026
These Terms of Service govern your access to and use of the SignTheDoc website and electronic-signature services. By creating an account or signing a document through our service, you agree to these terms.
Introduction
Welcome to SignTheDoc. SignTheDoc, Inc. ("Company," "SignTheDoc," "we," "our," or "us") provides these Terms of Service ("Terms") to govern your use of our website, applications, and electronic-signature and related services (collectively, the "Services").
By accessing our website, creating an account, or sending or signing a document through the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, you must discontinue use of the Services.
Company Overview
SignTheDoc, located at 30 N Gould St, Sheridan, Wyoming 82801, provides a software platform for preparing, sending, signing, and storing legally binding electronic signatures. We provide the tools; you are responsible for the documents you create and send using them.
Not Legal Advice
SignTheDoc is a software provider, not a law firm, and we do not provide legal advice. Nothing in the Services or on our website constitutes legal advice or a substitute for advice from qualified counsel. You are solely responsible for the content, legality, and enforceability of the documents you send, sign, or store using the Services.
Eligibility and Account Responsibilities
You affirm that you are at least 18 years old and have the legal authority to enter into these Terms. You are responsible for safeguarding your account credentials and for all activity that occurs under your account, and you agree to provide truthful, complete, and accurate information and to notify us promptly of any unauthorized use.
Account Review and Approval
New accounts are reviewed before they may send documents for signature. This review helps protect recipients from fraudulent or abusive use of the platform. We may request additional information, and we may decline or suspend accounts that we believe present a risk of unlawful use, at our discretion.
Acceptable Use
You agree not to use the Services for any unlawful purpose, to send documents you are not authorized to send, to upload malicious code, to impersonate any person or entity, to send unsolicited or deceptive communications, or to attempt to gain unauthorized access to our systems or another user’s account.
- No fraudulent, forged, or deceptive documents
- No documents you lack authority or consent to send
- No malware, or attempts to disrupt or probe our systems
- No use that violates applicable law or third-party rights
Electronic Signatures and Legal Validity
SignTheDoc facilitates legally binding electronic signatures under the U.S. ESIGN Act, UETA, and the EU eIDAS regulation, and each completed document ships with a tamper-evident audit trail. You are responsible for ensuring that electronic signature is appropriate and permitted for your particular documents and jurisdictions.
Certain documents are excluded from electronic signature by law — including wills and testamentary trusts, certain family-law documents, court orders, and specific statutory notices. You are responsible for confirming that your use is permitted, and for any notarization or witnessing requirements, which the Services do not by themselves satisfy.
Fees and Billing
Paid plans are billed in advance on a recurring basis. Fees are non-refundable except where required by law. You may cancel at any time, and your plan will remain active through the end of the current billing period. We may change our fees on prospective notice.
Intellectual Property
The Services, including our software, design, and trademarks, are owned by SignTheDoc, Inc. and protected by law. You retain all rights to the documents and content you upload; you grant us a limited license to process them solely to provide the Services to you.
Privacy and Data Protection
We adhere to strict confidentiality standards. Please refer to our Privacy Policy for details on how we handle your data. We do not sell your personal information or mobile data to third parties for marketing purposes.
Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted or error-free.
Limitation of Liability
To the fullest extent permitted by law, SignTheDoc will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the amount, if any, you paid us for the specific service giving rise to the claim in the twelve months preceding it.
Indemnification
You agree to indemnify and hold harmless SignTheDoc, its officers, and agents from all claims or damages resulting from your breach of these Terms, your misuse of the Services, the documents you send, or any fraudulent activity on your part.
Dispute Resolution
Before pursuing legal action, both parties agree to attempt good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Sheridan County, Wyoming, before a single arbitrator, following the rules of the American Arbitration Association (AAA). Each party pays its own legal costs unless otherwise awarded.
Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.
Updates to Terms
We may revise these Terms at any time. Changes are effective immediately upon posting to our website. Continued use of the Services constitutes acceptance of the changes.
